Terms and Conditions and refund policy if joining as a tradesperson/company/service provider

You understand and agree that any ideas, initiatives, concepts, materials, downloaded, read by you or made known to you by the business and Internet Website of FindaTrade Ltd; remain the intellectual property of FindaTrade Ltd. You will not use them to form the basis of any business venture in this or any other country. They will not be disclosed by you to third parties for the same purpose, without the specific consent of FindaTrade Ltd.

You certify to the best of your knowledge, that any information you post on this site is accurate and that you are authorised to post this information. You also agree that you are responsible for the validity of the mobile number used for texts and that any failure to receive messages due to lack of signal, the number being inaccurate, turned off, out of service or other reason, is your responsibility.

You certify and agree that you are using this system in a genuine effort to find customers/work and not for any other purpose deemed by FindaTrade Ltd to be inappropriate including passing on details of jobs posted by our homeowner members to other trades people who are not members of this service. Nor may you advertise your ability to find other tradespeople.

You certify that your company will be responsible for all works whether the work was done by your company or by additional/external subcontractors. If you join offering services that are clearly not covered by your insurances and/or accreditations FindaTrade Ltd deems your business to be contravening these Terms & Conditions by providing job information to others (e.g. competitors of FindaTrade Ltd. such as job counselling services, marketing agents for other trades etc); your membership will be terminated and no refund will be made.

You certify and agree that you are trading in the country where your advertisement appears, legally with all supporting documentation, accreditations, insurances and legal requirements of that country and that you are registered to offer all the services you display

You understand and agree that this service is not liable for and you will not hold this service liable for any ratings given by your customers found through this service.

You understand and agree that any dissatisfaction with any work/job/project done by you may only be taken up by the customer and is a matter between you and the customer only. Any dissatisfaction/complaint will not be resolved through this service, its’ officers nor employees.

You understand and agree that any rating given by your customer must be for a genuine service provided or job/work/project done and is a matter between you and the customer and you agree not to ask us to get involved in any ratings disagreements.

You understand and agree that any details, including contact information, obtained by you through this service, remain the intellectual material of this service and that you will not sell or give this information to other organisations nor individuals.

You shall not
provide copyrighted materials without authorisation,
provide obscene or offensive material,
provide material whose nature and/or volume compromises the ability of FindaTrade Ltd to serve our websites (instances including but not limited to unreasonable consumption of disk space, Internet link bandwidth, CPU, and memory usage, as determined by FindaTrade Ltd's staff),
provide materials that are deemed by the government authorities as inappropriate or illegal. Any such government determinations will be binding on the customer, not FindaTrade Ltd's.

You understand and agree that “Spamming” or any type of unsolicited commercial or non-commercial email is strictly prohibited, and your account may be suspended if you are found to be doing so and will be reported to the authorities and your IP address will be passed on to concerned parties

You understand and agree that by joining, that we will retain your details and by using the parameters provided (and editable by you at any time) , we will send you details of jobs (including contact information) that match your profile so this is not considered as spamming but providing you with information that you have agreed to purchase in advance.

You understand and agree that we will only send and charge your for details of jobs if your account is :-
1.Switched ON and
2.Job notifications are switched on
3.The job matches the profile/parameters you selected or have edited since you joined.
4.We have validated the telephone number of the job poster by getting them to enter a security code sent to that number.
These parameters (3 above) will include but are not limited to:-
How many jobs you wish to have in a given period – We will not send any jobs to you if that limit is reached within the specified period. Where you have selected xx jobs per month, we will look back 30 days to see if you should receive any jobs and where you have selected xx jobs in a week we will look back 7 days.
The type of job/job descriptions you selected. (please note we will only send you a job if you selected that category/job description. e.g. if you selected house extensions, tile bathrooms and no other categories, we will only send jobs to you if the homeowner chooses one of those categories and it is validated by a FindaTrade administrator).
The size of job (you will specify in you account if you want, small, medium and or large jobs) is not provable in advance. You understand and agree that we have used these three categories of size, in order to price jobs more fairly and give you a discount but that we cannot guarantee the accuracy of these size estimates and they are therefore not a guarantee of actual job size. They are produced in good faith and broadly estimated using the job description and an estimate provided by the job author. You will not hold us liable for any differences between this broad author based estimate and the eventual job size.
Distance (as the crow flies) from your postcode. If for any reason (e.g. Cardiff to some towns in Northern Devon) the crows flies distance is less than 50% of the road distance, we will (if you do not make contact and if you request it, refund your purchase). This means that you should check before making contact the actual distance and where it is more than double the 'straight line/crows fly' distance, please write to us and tell us that you do not wish to make contact with that job for that reason.
To make this process even fairer we have given you the ability to select how far you are prepared to travel for small, medium and large jobs, separately.

PLEASE NOTE if you no longer wish to receive job notifications and contact details, you must log into your account and on the Dashboard page, suspend your account notifications. We do not accept written requests to do this for you and whilst your membership is active and your notifications are switched on, you may be sent job leads.

You understand and agree that when you create/amend your profile/parameters, that you will see the price that will be charged for any jobs we send to you that match your profile and that it is your responsibility to 'not select' any categories of jobs that you do not wish to be sent and charged for. Prices may change but we will give you one week's notice by email if the pricing formula changes on average more than 10% in any one year, in order to give you sufficient time to review the changes and update your account parameters should you wish to. By registering your credit/debit card(s) with PayPoint.net you agree that based on your preferences (e.g. how many jobs you want, size, distance type etc – see full list below), your card will be charged where there is a job match and your company is one of the 2, 3 or 4 companies selected to contact the job poster.

You understand and agree that you can edit any and all of your profile/parameters at any time and that this profile will be used in order to select which companies will receive the jobs and specifically if you are sent any jobs.

You understand and agree that when a job is posted it will be allocated based on its' primary purpose but it may contain smaller associated work in the description. For example Installing a shower may have some tiling work associated to it. You understand and agree that we will use this primary purpose to allocate the job, even if smaller associated work is not selected by you in your profile. It will be up to ensure the full job is completed and not just the primary work. You may of course use sub-contractors where this subsidiary work is not within your abilities.

You understand and agree that you can turn off your 'Job Notifications' at any time and that whilst your job notifications are turned off we will not send you any jobs. We may send you regular reminders that your account is turned off.

You understand and agree that we are sending you leads and not confirmed jobs. We take great care in attempting to weed out time wasters including validating phone numbers and getting the poster to enter a security code from that number but we have no control over a job poster's true intentions nor how you handle any communication with a job poster, either written, verbally or through the detail or lack of detail you place on our website.

You understand and agree that when you join (or convert from the old system) there will be a €1 deposit required by PayPoint.net, to validate your details. This money will be credited to your account to be used against job charges and is not lost but also it is not refundable.

You understand and agree that we reserve the right to remove any and all information that you have entered for ANY reason and specifically for system abuse. Abuse means trying to use the system in a non-reasonable manner e.g. signing up as a customer in order to give yourself a good rating or offering services that you are not registered to offer. FindaTrade Ltd take no responsibility for any information loaded to our website by our customers. If it is brought to our attention and we deem the material to be inappropriate, we will suspend the offending and any related accounts, either permanently or until any illegal or inappropriate data is removed.

You understand and agree that, should for any reason, there be any problems with your payment after any services have been supplied, that are not resolved quickly, we will be obliged to contact all homeowners who have received/viewed your details, to explain why you membership is no longer valid.

You understand and agree that you will fully indemnify FindaTrade Ltd against liability (of any nature), which may befall FindaTrade Ltd as a result of your illegal or fraudulent use of our services.

You understand and agree that FindaTrade Ltd is not responsible for any interruption of service, and accepts no liability for any loss of services, sales or any other form of loss.

You understand and agree that FindaTrade Ltd cannot be held liable for the accuracy of the information provided in all references obtained by FindaTrade Ltd, either directly from the referee or via you or your representatives. Where FindaTrade Ltd makes direct contact with a referee, we verbally ask them to confirm the accuracy and ask them to visit our site to review and validate the content but we cannot guarantee they will do so. It is your responsibility to ensure the accuracy and validity of all references posted against your account.

You understand and agree that should there be a dispute of any kind, we have the right to the final say/decision in resolving the dispute. We undertake to use reasonable judgement in any dispute and indeed to refuse to arbitrate where disputes fall into the above categories.

We make several checks to ensure that the jobs posted are from genuine sources (email verification, telephone calls, telephone number and address checking, security codes used to activate) but you understand and agree that we have no way of ensuring requests made are totally genuine searches for tradespeople. Therefore, you accept that for any reason, should a job prove not to be genuine, you will not hold FindaTrade Ltd liable and you will not be entitled to any refund. However FindaTrade Ltd recognises that in some cases a job that was posted maliciously and will re-credit you account where this is easily proven. (Please see refund policy for full details)

We expect you will need to make contact by email if there is no reply by telephone. We systematically check the authors email address and IP address before publishing any jobs. You may only report 'inability to contact' issues if you have tried more than once to make contact within 24 hours of notification that the job is available. If after 2 business days of no contact/reply your must write to us and tell us what efforts you made using the report problem feature 'Contact Issues' in your account. We will contact the author and any other company who has promised to contact the author and if the job and contact details (email address) are genuine then this will be a matter between you and the author or if it is not genuine we will re-credit your account.

You understand and agree that once you have contacted the homeowner / job author it is entirely in their hands as to whether or not they proceed with their request. They may choose not to invite you to produce a quote or estimates and that as this may be in some cases due to the lack of supporting information about your company, (references, insurance details, accreditations etc), it may also be due to other reasons e.g. your distance from the job, poor ratings, the conversation you had with them, what they read about you on the site, you cannot hold Findatrade Ltd responsible and you will not be entitled to any refund. We will put you in touch with a live job but events after that are beyond our control.

You accept that you will not hold FindaTrade Ltd liable for the 'seriousness' nor the intention or lack of intention of purchasing your services on behalf of the job author. We cannot guarantee you work. We ask the job posters questions designed to weed out time wasters (e.g. why do you want an estimate....with answers ranging from 'the work is required and I just want to select a company, to ' just looking for an idea of price' and 'I am looking for subcontractors' and we will not send you jobs where people are just looking for a price and questions like ..are you a homeowner/individual, or a tradesperson or a business but we cannot guarantee the validity of their answers.

You understand and accept that you are buying the homeowner contact information and not the promise of work. It is entirely between you and the job author whether or not this contact leads to any work.

If you have made reasonable effort to contact a job author without success and this must include email and telephone calls, You must write to us (within 10 days of purchase) by logging in and using the specific Report Contact feature with specific details regarding the job title, date posted, location and what contact efforts you made, FindaTrade Ltd will investigate and if they deem the contact to be 'suspect' they will re-credit your account. You may only report JOB GONE and NO CONTACT issues if you have tried more than once to make contact within 24 hours of purchase.

In the event that FindaTrade Ltd considers a credit to not be appropriate, and you wish to pursue the matter, FindaTrade Ltd will not provide any contact information for the job poster unless legally required to.

Any claim for reimbursement must be made within 10 days of the purchase of the contact details. A homeowner changing their mind about a requirement for work is not a valid reason for a reimbursement and is between you and the homeowner and you agree any estimates that you provide will be free and may not always require a site visit unless otherwise agreed with the homeowner.

You understand and agree that any dates and specifications provided by the homeowner are estimates and you will not hold FindaTrade Ltd responsible for their accuracy. You also understand and agree that we ask for the job authors to provide as detailed a description as possible but this job description is provided by the homeowner alone and any errors or inaccuracies are not our responsibility but between you and the homeowner.

Please be aware the distance shown is a straight line distance between your postcode and the postcode of the job as provided by Google maps. For an accuarate driving distance we recommend you use your postcode/town and the job's postcode/town on www.viamichelin.fr before purchasing.

You understand and agree that any fee includes all features regarding advertising your details, your details being notified to our members who are looking for you, recommendations/ratings and emailing/texting of new jobs posted but that we do not guarantee you will receive any job notifications, that this is dependent on homeowners posting jobs for your job categories in your coverage area.

The companies selected to receive any jobs will be selected using a formula that contains the following parameters.
The job matches your job matching criteria (editable 24/7 by you)
Your 'Job Notifications' are switched on
How far you are from the job (preference is given to tradespeople closest to the work)
The quality of your additional information (a weighting is given to companies who have added details such as
insurance details completed x3
at least 1 reference
at least one qualification/membership
description of at least 250 characters
company image
at least 1 gallery photo
Notwithstanding a technical fault or anti blocking ISPs You will receive an email and telephone (mobile) text within a few minutes of a job being approved by our admin staff. Prompt customer contact (and having an updated, detailed profile of your business) will improve the likelihood of securing the work. Homeowners will use this information to help make their selection.

You also understand and agree that if you ever choose to close your account, any outstanding charges will be taken from your debit/credit card, immediately.

You understand that in accordance with European law regarding the provision of services that cannot be returned, you do not have the right to any refund once the service has been provided except where the homeowner refused contact or had already chosen another company. In this event you must use the report contact feature on the site and we will investigate and refund your FindaTrade account where the has been a genuine problem. If you have any questions regarding this matter, please write to member-support@findatradeinfrance.com.

You understand and agree that normally we are able to approve memberships very quickly with a few simple checks and validation of your SIRET number and matching details but that we may request that you provide documentation (e.g. SIRET papers, certificates, telephone bills) in order to validate your membership details and registration. Please note that some trade members choose to use their personal details (e.g. address, telephone number etc.) as their business contact details. If you do not want any of you details published on our site or through Google, Yahoo and other search engine pages via our site, please do not register with us.

You understand and agree that to be sent the contact details for any job your account must be switched on and you must be signed up with a valid credit or debit card. You will be sent job contacts as long as your 'Job Notifications' are switched on (you control this) and there is a job match (you alos control the matching criteria). You will have seen the price of each job at sign up or you can view the price of all jobs at any time when you go to edit your details. When you are sent the contact information of any job (by email and telephone text message) your account will be debited by the amount published for that job, its' size and whether or not is a materials only or labour and materials quote. Your transactions will be viewable within your account, along with details of all job contacts sent to you and receipts 24/7.

We therefore never make any charges against you except for the job contact details you have been sent as defined by the criteria you select and control. Only you can commit to charges on the site, this is done at sign up. You can change your payment credit or debit card at any time. No-one from FindaTrade Ltd will ever ask you for your credit/debit card or bank details.

You understand and agree that all transactions are final and that no refunds are available, as services cannot be returned. If for any reason FindaTrade Ltd decide to refund any monies/fees, a fee may become due, to cover any fiscal and/or administration charges and that all advertised promotions including free or reduced charges will become deductible. If you break any of these Terms & Conditions you will not be eligible for a refund.

You understand and agree that we are only able to offer free advertising because you have agreed to to receive notifications of jobs posted by our homeowner members. If you decide not to receive job notifications, all free advertising will cease.

Cancelling your membership does not cancel your agreement to our Terms & Conditions.

FindaTrade Ltd reserves the right to make changes to these terms and conditions without prior notification and all such changes will be viewable on this website..

FindaTrade Ltd reserves the right to alter the way it operates its' method of membership/advertising at any time and without notice.

FindaTrade Ltd reserves the right to revise this Legal Notice at any time without any notice to you. You should check this Website from time to time to review the then current Legal Notice, because it is binding on you.

Refund policy

We therefore never make any charges against you except for the job contact details you have been sent as defined by the criteria you select and control. Only you can commit to charges on the site, this is done at sign up. You can change your payment credit or debit card at any time. No-one from FindaTrade Ltd will ever contact you and ask you for your credit/debit card or bank details.

Overview
We treat problems regarding contact seriously and there are 2 scenarios where we will re-credit your account following the purchase of job contact details.
1.You were never able to make contact either by email or telephone
2.The first time you made contact you were told the job had already been taken or had been removed. (see important exceptions below)
We are committed to ensuring that any time you are either:-
not able to contact a job author or
when you did make contact the work was no longer available
your account will be re-credited if processed within the reporting/warranty period and not an exception detailed below.

There is a feature when you log in called Report Contact Issues. You must use the form on this page to report any appropriate contact problem (for reasons of efficiency and detail of information we do not accept other methods of reporting). The information you give will be automatically communicated to the homeowner for confirmation (and we may contact the other tradespeople who made contact) and if confirmed, then your account will be re-credited.

Important exceptions
We have a detailed job posting process which has been very successful in weeding out time wasters but it is impossible for us to investigate why homeowners change their minds as once contact has been made this can be because of so many different (and often personal/situational) reasons, how you communicated and may also be as a result of the homeowner having viewed your details on our site (please make sure they are up to date including insurances, accreditations, references etc.), which is why all we can promise is that at the time of first contact there will be a live job but if the homeowner does not return first contact or says there is no job available we will ask them to confirm this and if no confirmation is received or they confirm that was the case we will immediately re-credit your account. Therefore please note that... We promise to put you in touch with a live job contact but once that contact is made we have no control over any events that follow. If at any time within our terms and conditions, we confirm that no contact was possible or that the job had gone before contact was made, we will issue a refund immediately.

Please note - We cannot process claims where the homeowner found that your additional information (a comprehensive description of your services and experience, insurance details, qualifications, associations, accreditations and certificates etc.) were 'lacking in any reasonable detail' or where the distance travelled to the job will exceed 50 kilometres or where your average rating over all jobs rated, is less than 3. Homeowners will see this information before you contact them and will often reject any approach where the distance is too great or where this information is 'sketchy' or quality is below average. Findatrade Ltd promises to use reasonable judgement when deciding what constitutes 'sketchy' or 'lacking any reasonable details' and we have set 50 kilometres 'as the crow flies' as the maximum distance where we will consider a refund if the 'job has already gone' but we also reserve the right to have the final say in this matter, including where actual travel distance far (unreasonably) exceeds 'crow flies' distance.
Also when a job is posted it will be allocated based on its' primary purpose but it may contain smaller associated work in the description. For example Installing a shower may have some tiling work associated to it. We will use this primary purpose to allocate the job, even if smaller associated work is not selected by you in your profile. It will be up to ensure the full job is completed and not just the primary work. You may of course use sub-contractors where this subsidiary work is not within you abilities but no requests for refund can be accepted where you decide that you did not want the work because the smaller associated work was not selected by you in your profile.

Despite the job posting process we cannot guarantee that there is genuine work at the end of an enquiry and our pricing formula does take into account when the work is required to start and many other factors. If a homeowner is only looking at the possibility of doing some work (they may be considering a house purchase) we cannot be held responsible for how serious their intentions are. We cannot guarantee you work. We ask the job posters questions designed to weed out time wasters (e.g. why do you want an estimate....with answers ranging from 'the work is required and I just want to select a company, to ' just looking for an idea of price' and 'I am looking for subcontractors' and we will not send you jobs where people are just looking for a price and questions like ..are you a homeowner/individual, or a tradesperson or a business but we cannot guarantee the validity of their answers. We do ask them to agree to the following terms and conditions as an added indication that they are seriously considering some work.

You understand and agree that by posting a job on this site you are:-
Genuinely looking for either work to be carried out or an estimate to help you decide whether or not to do the work
Promise to let any trade company (registered on our site and with the correct security code) that contacts you within your specified reply time limit, to provide an estimate for the job posting.
Are responsible for the job as posted and its' details. You promise that all details are true and relevant.
Are responsible for removing the job from our website once it has been allocated or you have decided not to pursue it.
Please note that no homeowner is under any obligation to give you their address as long as they are happy for you to quote without a visit. If they are preventing you from quoting completely then we will investigate and if found to be the case we will remove the job and reimburse you.

Reporting/warranty period
The system is designed to only allow members to report a contact issue if it is within the reporting period of the terms and conditions (between 2 and 10 days of purchase). or immediately and up to 10 days if the job was not available. For example...
If you purchase contact information on the 1st of the month but wait for 12 days to report no contact, that would be outside our 10 day reporting requirement and therefore would not be selectable in your account for reporting and no longer within warranty. (Contact with homeowners is usually within 1-3 days and therefore 10 days is more than sufficient to deal with any contact issues. Longer than this and it becomes very difficult to ask homeowners to remember what happened)
If you did make contact but 11 days after purchase, that job would also not be eligible for reporting.
If you purchased the job contact on the 1st and wanted to report no contact before the end of the next day, that is too soon and the job would not be available for reporting until 48 hours had passed. After 48 hours and for another 8 days that job will remain reportable in your account.

Therefore only jobs that fall into the above categories will be available to report on the Report Issue page. Please use the form on this page to report any problem, the information you give will be automatically communicated to the homeowner for confirmation (and we will also contact the other artisans who purchased the contact information) and if confirmed, then your account will be re credited.

Please note that you have purchased credit on our system and refunds to your bank account can only be made if requested within 14 days of the original credit. Any job refunds agreed by Findatrade Ltd. will be credited to your Findatrade account. Any refunds to your bank (within 14 days) will be after all promotional bonuses and free offers have been deducted from your balance and will include a €5 administration fee. You may only report 'inability to contact' issues if you have tried more than once to make contact within 24 hours of notification that the job is available.

Refund of any Preloaded Credit remaining in your account.

Other than requesting a refund within 14 days of adding the credit, you may get a refund of you balance (minus any closure charges (usually €5)) if you have kept your account switched on for a minimum of 4 months and you have not received any job contacts. At this point you will have 2 choices, to get a 50% refund and keep you account open or get a full refund (minuses closure charges) and have your account and advert closed. This policy is subject to fair usage and is invalid if you have altered your parameters to ensure no jobs are received. Your original parameters will be used as a yardstick to measure changes.

It is not in our interests to be heavy handed with contact and availability problems so we have designed the system of reporting to be open and fair and that includes the need for a time limit.

When you join (or convert from the old system) there will be a €1 charge made against your card as required by PayPoint.net, to validate your details. This money will be credited to your account to be used against job charges and is not lost but also it is not refundable.

Advert Plus
For refunds of Advert Plus subscriptions, our policy is as follows.
All requests for refunds of Advert Plus payments must be made within 7 days of payment. You understand that in accordance with European law regarding the provision of services that cannot be returned, you do not have the right to any refund. The majority of the fee that is paid for the advert plus service is for the set up of your on-line web page, the editorial validation of the content by members of staff and the ongoing monitoring of the content and publication on the Internet. If for any reason Findatrade Ltd decide to refund any monies/fees, any services you have received (including time spent -formula available on request), as well as any promotional bonuses, including job contact details purchase bonuses, will be deducted from any refund agreed as well as a €5 administration charge for processing.

Abuse of the reporting contact issue system may result in cancellation of your membership
